These Terms of Service ("Terms") are an agreement between you and Super Clear LTD ("we", "us", "our"). They govern your use of FocalBrief: the web app at app.focalbrief.com, the FocalBrief Chrome extension, and the emails we send you (together, the "Service"). By creating an account or using the Service you agree to these Terms and confirm that you have read our Privacy Policy.

1. The Service

FocalBrief analyses the browsing data you choose to give it, from a browser history upload and from the extension, and produces reports on your focus, your interests and how they change over time. Reports are refreshed weekly while your subscription is active. We may change, add or remove features to improve the Service.

2. Eligibility

You must be at least 16 years old to use the Service. By creating an account you confirm that you are.

3. Your account

You sign in with your Google account. Keep that account secure: you are responsible for activity under your FocalBrief account. Tell us straight away at [email protected] if you think someone else has accessed it. Access may start on a waitlist; we decide when to grant access.

4. Subscription, payment and cancellation

  • Price and billing. Access to the Service requires a paid subscription. The price and billing period are shown at checkout, before you pay. Your subscription renews automatically at the end of each billing period, and we charge the payment method you gave us, until you cancel. Payments are processed by Stripe.
  • Price changes. We will tell you about a price change at least 30 days before it applies. It applies from your next renewal, and you can cancel before then.
  • Cancelling. You can cancel at any time by emailing [email protected]. You keep access until the end of the period you have paid for, and you will not be charged again.
  • Refunds. You may cancel within 14 days of your first payment for a full refund, unless your first report has already been generated: at checkout you ask us to start the Service immediately and acknowledge that you lose this right once your report is delivered. Renewal payments are not refunded, except where the law requires.

Nothing in these Terms affects your statutory rights as a consumer.

5. Your content

"Your content" is the data you give the Service: uploaded browsing history, activity recorded by the extension, questionnaire answers, interests, beliefs, profile details and pages you save. You keep all rights in it. You give us a non-exclusive, worldwide, royalty-free licence to store, process and display your content only as needed to provide the Service to you, as described in the Privacy Policy. The licence ends when your content is deleted. We do not sell your content or use it to train AI models.

You are responsible for having the right to give us the content you upload.

6. AI-generated reports

Your reports are generated automatically, partly by AI language models, from your own browsing data. They may be incomplete or wrong. They describe patterns in your data. They are not professional, medical, psychological, career or financial advice, and you should not rely on them as such.

7. Acceptable use

You agree not to:

  • use the Service in breach of any law, or to infringe anyone else's rights;
  • upload data about another person without their permission;
  • reverse-engineer, disrupt, overload or try to gain unauthorised access to the Service or the systems behind it;
  • scrape the Service, or resell or redistribute it without our written permission.

8. Our intellectual property

The Service and its software, design and content (apart from your content) belong to Super Clear LTD or its licensors. We grant you a personal, non-transferable licence to use the Service under these Terms.

9. Availability and disclaimer

We work to keep the Service available and accurate, but it is provided "as is" and "as available". To the extent the law allows, we make no promises that it will be uninterrupted, error-free or fit for a particular purpose.

10. Limitation of liability

Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Otherwise, to the extent the law allows:

  • we are not liable for indirect or consequential loss, or for loss of profit, business or data; and
  • our total liability to you for all claims is limited to the amount you paid us in the 12 months before the claim.

11. Suspension and termination

You can stop using the Service and ask us to delete your account at any time (see the Privacy Policy). We may suspend or end your access if you seriously or repeatedly breach these Terms, or if the law requires it. Unless the breach makes that inappropriate, we will tell you first. If we end the Service entirely, or end your access for a reason that is not your breach, we will refund any unused prepaid period.

12. Changes to these Terms

We may update these Terms. We will change the effective date above and, for material changes, tell you by email or in the app at least 14 days before they take effect. If you do not agree, you can cancel before then.

13. Governing law

These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK or in the EU, you keep the protection of the mandatory consumer laws of your country, and you may bring proceedings in your local courts.
